These Terms of Service govern the electronic signature service (the "Service") that ZincirX Inc. ("the Company", "we") provides at pqc-imza.com and through the PQC Imza mobile app, operated on its behalf by ZincirX Bilişim Teknoloji ve Danışmanlık A.Ş.. By using the Service you accept these terms. If you do not accept them, do not use the Service.

1. What the Service does

PQC Imza lets you upload or build a PDF document, name the people who should sign it, have it signed with post-quantum cryptography (ML-DSA), and record the signed document's fingerprint (hash) on the SciChain blockchain. Signing keys are created and kept on the signer's own device (the PQC wallet browser extension or the mobile app); your private keys are never sent to our servers.

2. Legal standing of the signature

Signatures made with PQC Imza are not "secure electronic signatures" (güvenli elektronik imza) under Turkish Electronic Signature Law No. 5070 and do not rely on a qualified electronic certificate. They are advanced electronic signatures: they show cryptographically that the signer signed the document and that it has not changed since, and they can be used as evidence. They are not suitable for transactions that by law require a secure electronic signature, an official form or a handwritten signature (for example the sale of real estate, a guarantee agreement, or acts that must be done before a notary). Deciding which form a document requires is your responsibility; take legal advice where needed.

3. Your account

• You can sign in with Google or with your PQC wallet. To create and sign documents you must complete your profile (full name, Turkish national ID number, email) and link a PQC wallet.
• You are responsible for giving accurate, current information. You may not open an account in someone else's name.
• You are responsible for the security of your wallet and device. We cannot recover a lost private key; if you suspect your key has been compromised, tell us at once.
• The Service is not for people under 18.

4. Documents and content

• The content of the documents you upload or create belongs to you. We process and store documents only to provide the Service.
• If a document contains other people's personal data, you are responsible for having a lawful basis to process it. For that data you are the data controller and we are the data processor.
• A blockchain record is permanent and public. When a document is recorded on the blockchain, its hash, the signature hashes, the signers' wallet addresses and a label of the form "PQC Imza #document number" are stored on SciChain permanently and cannot be deleted. The document's content and title are not written to the blockchain.
• You may not use the Service for unlawful content, content that infringes others' rights, or for fraud or forgery.

5. Fees and payment

• The person who creates a document pays a per-document fee when the document is sent for signature, or uses a credit bought in advance. Signing is free for signatories. Current prices are on the pricing page and in the Pre-Contractual Information.
• Payments are taken through Stripe. Your card details are processed by Stripe; we never see or store your card number.
• A plan is a subscription that renews automatically for the same period until you cancel it from Manage subscription; it then ends at the close of the period already paid. Each period's documents are used before purchased credits and lapse at the end of the period.
• On a plan with more than one seat (Pro: 5 people, Business: 20) the subscriber may invite people with a PQC Imza account to use the plan's documents. The subscriber pays for the plan, is responsible for the people they invite and can remove them at any time; a member can leave at any time. When the plan ends, so do its seats.
• Purchased credits do not expire. Sales are subject to the Distance Sales Agreement and the Cancellation and Refund Policy.

6. Availability

We take reasonable care to keep the Service running without interruption or error, but maintenance, updates, problems at third-party services (hosting, payments, the blockchain network) or events beyond our control can cause temporary outages. Blockchain recording depends on the SciChain network being available.

7. Limitation of liability

To the extent the law allows, we are not liable for the content of signed documents, for your obligation to verify who your signers are, for the form a document legally requires, or for loss arising from the loss or compromise of devices or keys under your control. Liability for intent and gross negligence, and consumers' statutory rights, are not affected. For users who are not consumers, our total liability is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

8. Closing your account

You can ask us to close your account at any time. We may suspend or close an account that seriously breaches these terms. What happens to your data when an account is closed is explained in the Privacy Policy and, for users in Türkiye, the KVKK Notice.

9. Changes

We may update these terms. We will announce material changes by email or in the Service before they take effect. Continuing to use the Service after a change means you accept the updated terms.

10. Governing law and disputes

These terms are governed by Turkish law. Consumers may apply to the Consumer Arbitration Committee where they live, within the monetary limits set each year by the Ministry of Trade under Consumer Protection Law No. 6502, and to the Consumer Courts above those limits. For users who are not consumers, the courts and enforcement offices of Istanbul (Çağlayan) have jurisdiction.
